Some IT contracts continue for several years. At the end of the contract, the question arises of the transition to a new service provider or an internal team of the customer. And sometimes the client is not ready for the end of the contract and asks the provider for a grace period.

Sometimes the negotiation goes well. Sometimes it’s more complicated.

If you are in this situation (provider or client), it is important to know that a judge can grant a grace period to the client by forcing the provider to continue the performance of the contract.

The request made to the judge must be (very) well justified, and the grace period requested must be reasonable.
